Pickle Haus Social Indoor Pickleball Facility

Liability Waiver, Assumption of Risk, Release, Indemnity, Medical Consent, and Facility Access Agreement

If Participant is under 18:

This Liability Waiver, Assumption of Risk, Release, Indemnity, Medical Consent, and Facility Access Agreement “Agreement” is entered into by the undersigned participant, visitor, guest, spectator, member, parent, legal guardian, group organizer, payor, or other person entering or using the facility “Participant,” in favor of Pickle Haus Social, its owners, members, managers, officers, directors, employees, agents, representatives, instructors, coaches, independent contractors, volunteers, affiliates, landlords, property owners, sponsors, event organizers, vendors, insurers, successors, and assigns collectively referred to as the “Released Parties.”

This Agreement applies to all visits, memberships, reservations, open play, clinics, lessons, leagues, tournaments, rentals, private events, sponsored events, birthday parties, group events, spectating, use of the premises, use of equipment, and participation in any activity at or associated with Pickle Haus Social, whether occurring on the premises, in adjacent sidewalks, parking areas, entryways, or at any off-site sponsored activity.

This Agreement is intended to apply to the fullest extent permitted by Texas law.

1. Acknowledgment and Assumption of Risk

I understand and acknowledge that pickleball, athletic activity, recreational activity, facility use, spectating, and being present at an indoor sports facility involve inherent and unavoidable risks. These risks include, but are not limited to:

• being struck by pickleballs, paddles, equipment, doors, fixtures, or other objects;

• collisions with other players, spectators, walls, nets, posts, benches, doors, barriers, fences, furniture, or equipment;

• slipping, tripping, or falling on court surfaces, transitions, walkways, entryways, bathrooms, locker areas, lounge areas, sidewalks, or parking areas;

• injuries caused by sudden stops, starts, turns, lunges, pivots, overextension, or loss of balance;

• sprains, strains, fractures, bruises, cuts, abrasions, eye injuries, dental injuries, head injuries, concussions, neck injuries, back injuries, paralysis, disability, or death;

• overexertion, dehydration, dizziness, fainting, heat illness, heart-related events, stroke, cardiac arrest, or other medical events;

• aggravation of a prior injury, illness, or medical condition;

• equipment failure, equipment malfunction, court-surface conditions, lighting conditions, facility conditions, or maintenance conditions;

• negligent, reckless, careless, or intentional conduct by other participants, visitors, spectators, guests, or third parties;

• risks related to instruction, coaching, clinics, drills, open play, league play, tournaments, private events, social events, and group activities;

• theft, loss, or damage to personal property, vehicles, equipment, bags, paddles, phones, valuables, or other belongings;

• exposure to communicable diseases, viruses, bacteria, respiratory illness, skin infections, or other illness from other persons or shared spaces.
  

I understand that Pickle Haus Social strongly recommends that I consult with a physician before participating in any exercise, athletic activity, or pickleball activity. I certify that I am physically able to participate or be present at the facility and that I am responsible for determining whether any activity is safe for me.

I voluntarily choose to enter, use, visit, spectate, or participate at Pickle Haus Social. I knowingly and voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, including the risk of injury, illness, disability, death, property loss, or property damage.

2. Release of Liability, Including Ordinary Negligence

I UNDERSTAND THAT THIS AGREEMENT RELEASES AND WAIVES LEGAL CLAIMS.

I UNDERSTAND THAT I AM RELEASING PICKLE HAUS SOCIAL AND THE OTHER RELEASED PARTIES FROM CLAIMS ARISING FROM THE RELEASED PARTIES’ OWN ORDINARY NEGLIGENCE, TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW.

In consideration for being permitted to enter, visit, spectate, use the facility, purchase or use a membership, purchase or use a facility pass, reserve courts, attend events, participate in activities, or otherwise receive access to Pickle Haus Social, I hereby release, waive, discharge, and covenant not to sue the Released Parties from and against any and all claims, demands, causes of action, damages, losses, liabilities, costs, expenses, or attorney’s fees arising out of or related to:

1. my entry into or presence at Pickle Haus Social;

2. my participation in pickleball or any other activity;

3. my use of courts, equipment, amenities, lounge areas, locker areas, restrooms, sidewalks, parking areas, or any part of the premises;

4. instruction, coaching, advice, programming, open play, clinics, leagues, tournaments, rentals, or events;

5. any slip, trip, fall, collision, contact, equipment malfunction, facility condition, or act or omission of another participant or third party;

6. any personal injury, illness, disability, death, property damage, property loss, or theft;

7. any claim arising from the ordinary negligence of the Released Parties.

   
   

This release applies to claims I have now, may have in the future, or that may be brought by or on behalf of me, my heirs, assigns, personal representatives, next of kin, spouse, family members, estate, or any person claiming through me.

This Agreement does not release claims that cannot legally be released under applicable law.

3. Indemnity, Defense, and Hold Harmless

I AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS PICKLE HAUS SOCIAL AND THE OTHER RELEASED PARTIES.

To the fullest extent permitted by Texas law, I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, causes of action, damages, losses, liabilities, judgments, settlements, costs, expenses, and attorney’s fees arising out of or related to:

1. my entry, presence, participation, conduct, or use of Pickle Haus Social;

2. my violation of this Agreement or any facility rule;

3. my negligent, reckless, intentional, unsafe, or improper conduct;

4. my sharing or misuse of any PIN code, digital key, access link, credential, membership account, or reservation;

5. any injury, loss, or damage caused by me to another person or to property;

6. any claim brought by or on behalf of my guest, invitee, family member, child, minor participant, group member, or person I allow or assist in entering the facility;

7. any claim arising from my failure to ensure that my guest, invitee, family member, child, minor participant, or group member signs a required waiver before entering, spectating, or participating.

This duty to indemnify, defend, and hold harmless includes claims alleging ordinary negligence by the Released Parties, to the fullest extent permitted by Texas law.

4. Medical Fitness, Medical Consent, and Medical Expenses

I certify that I am in good health and physically able to participate in pickleball, exercise, and related activities, or that I have obtained medical advice allowing me to participate. I understand that I am solely responsible for monitoring my own physical condition.

I agree that I will not participate if I am experiencing dizziness, chest pain, shortness of breath, illness, injury, impairment, or any condition that makes participation unsafe.

I authorize Pickle Haus Social staff, representatives, or other responsible persons to obtain or request emergency medical assistance for me if they believe it is necessary or appropriate. I understand that Pickle Haus Social has no duty to provide medical care, medical screening, or emergency rescue services.

I accept full responsibility for all medical expenses, ambulance charges, emergency care expenses, treatment expenses, follow-up care, rehabilitation, insurance deductibles, and related costs arising from any injury, illness, or medical event.

I understand that I am responsible for maintaining my own health insurance or medical coverage.

5. Communicable Disease and Illness

I understand that entering, visiting, spectating, or participating at an indoor facility may involve exposure to communicable diseases, viruses, bacteria, respiratory illness, skin infections, or other illnesses. I voluntarily assume these risks.

I agree not to enter the facility if I have symptoms of a contagious illness, have been advised to isolate, or know that my presence would create an unreasonable health risk to others.

6. Facility Rules, Conduct, and Right to Remove

I agree to follow all Pickle Haus Social rules, posted signs, safety instructions, staff directions, membership terms, reservation terms, court rules, and access policies.

I agree to conduct myself safely and respectfully. I will not engage in unsafe, aggressive, abusive, threatening, harassing, disruptive, intoxicated, impaired, or inappropriate behavior.

I understand that Pickle Haus Social may refuse entry, remove any person, suspend access, terminate membership privileges, cancel reservations, or impose additional fees or penalties for violation of this Agreement, facility rules, access policies, safety rules, or staff instructions.

I agree not to participate while impaired by alcohol, drugs, medication, fatigue, illness, injury, or any other condition that may make participation unsafe.

7. Facility Access, PIN Code, Digital Key, and Credential Use

To ensure fair use, safety, and security, each player, member, guest, visitor, and participant must enter the facility using their own valid access method. Depending on the technology in use, this may include a unique PIN code, digital key, access link, membership credential, reservation credential, or other approved entry method.

Access credentials are personal, non-transferable, and may not be shared.

I agree that:

1. I will enter the facility only with my own assigned or approved access credential;

2. I will not share, forward, lend, sell, post, publish, or otherwise allow others to use my PIN code, digital key, access link, membership account, reservation credential, or other access method;

3. I will not allow unauthorized persons to enter with me;

4. I will not prop open doors or bypass access systems;

5. I am responsible for guests, family members, group members, or invitees who enter with me or through my access credential;

6. I will promptly notify Pickle Haus Social if I believe my credential has been lost, stolen, shared, compromised, or misused.

   
   

I understand that facility entries may be monitored and logged for safety, security, billing, access verification, usage tracking, and rule enforcement.

I acknowledge that misuse of access credentials may result in access penalties, suspension, membership termination, additional fees, cancellation of reservations, or other remedies available to Pickle Haus Social.

8. Group Reservations, Payor Responsibility, and Guests

If I reserve courts, purchase passes, book an event, pay for a group, organize a group, host a party, or otherwise arrange access for other persons, I agree that I am the “Group Organizer” and/or “Payor” for that group.

As Group Organizer and/or Payor, I agree that:

1. I am responsible for communicating facility rules and waiver requirements to all members of my group;

2. every adult participant, guest, visitor, and spectator in my group must sign Pickle Haus Social’s waiver before entering, spectating, or participating;

3. every minor in my group must have a waiver signed by that minor’s parent or legal guardian before entering, spectating, or participating;

4. I will not represent that I have authority to waive another adult’s legal rights unless I have legal authority to do so;

5. I will not allow unauthorized entry or credential sharing;

6. I am responsible for damage, misuse, rule violations, unauthorized access, or unsafe conduct caused by me or members of my group;

7. I agree to indemnify, defend, and hold harmless the Released Parties from claims arising from my group, my guests, my invitees, my event, my reservation, or my failure to ensure that required waivers are signed.

This section applies to group reservations, private events, parties, court rentals, team events, clinics, leagues, tournaments, sponsored events, and any situation where one person pays for, reserves, coordinates, or arranges access for others.

9. Minor Participant Parent / Legal Guardian Agreement

This section applies if the participant is under 18 years of age.

I certify that I am the parent, legal guardian, or legally authorized representative of the minor participant named above and that I have authority to sign this Agreement.

I understand that pickleball, athletic activity, spectating, and being present at an indoor sports facility involve risks of injury, illness, disability, death, property loss, and property damage. I knowingly and voluntarily allow the minor participant to enter, visit, spectate, use the facility, and/or participate in activities at Pickle Haus Social.

To the fullest extent permitted by Texas law, I release, waive, discharge, and covenant not to sue the Released Parties for any claims that I personally may have arising out of or related to the minor participant’s entry, presence, participation, use of the facility, injury, illness, disability, death, property loss, or property damage.

To the fullest extent permitted by Texas law, I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, causes of action, damages, losses, liabilities, judgments, settlements, costs, expenses, and attorney’s fees brought by or on behalf of the minor participant, or arising out of or related to the minor participant’s entry, presence, participation, use of the facility, injury, illness, disability, death, property loss, or property damage.

I understand that this parent/guardian indemnity obligation applies even if a claim alleges ordinary negligence by the Released Parties, to the fullest extent permitted by Texas law.

I agree that I am responsible for supervising the minor participant or ensuring appropriate supervision. I authorize emergency medical treatment for the minor participant if deemed necessary or appropriate. I accept full responsibility for all medical expenses and related costs involving the minor participant.

10. Surveillance, Security, and Access Monitoring

I understand that Pickle Haus Social may use video surveillance, access logs, door activity logs, reservation records, membership records, cameras, and other monitoring systems for safety, security, access verification, usage monitoring, operations, rule enforcement, incident review, and protection of property.

I understand that surveillance and access monitoring do not guarantee my safety, do not guarantee the security of my property, and do not create a duty by Pickle Haus Social to monitor the facility continuously or prevent all injuries, misconduct, theft, unauthorized entry, or criminal acts.

I understand that there is no expectation of privacy in public or common areas of the facility. Pickle Haus Social does not intentionally place surveillance cameras inside restrooms.

11. Photo, Video, Audio, and Marketing Media Release

I understand that photos, videos, audio recordings, or other media may be captured during activities, events, open play, leagues, tournaments, clinics, parties, rentals, promotional activities, or facility operations.

I grant Pickle Haus Social permission to use my name, image, likeness, voice, photograph, video, or other media for legitimate business, marketing, promotional, advertising, social media, website, print, news, sponsorship, and operational purposes without compensation.

This may include, but is not limited to, use in brochures, flyers, local publications, social media, websites, advertisements, promotional materials, event recaps, and facility communications.

I understand that I may opt out of promotional media use by providing written notice to Pickle Haus Social. I understand that the opt-out may not apply retroactively to media already published, printed, posted, distributed, or used before Pickle Haus Social receives and processes the written opt-out.

For minors, the parent or legal guardian signing this Agreement grants this permission on behalf of the minor participant unless the parent or legal guardian opts out in writing.

12. Personal Property, Vehicles, and Parking Areas

I understand that I am solely responsible for my personal property and valuables.

Pickle Haus Social is not responsible for loss, theft, or damage to personal property, vehicles, vehicle contents, paddles, bags, phones, wallets, keys, equipment, clothing, or valuables, whether occurring inside the facility, outside the facility, in entryways, on sidewalks, or in parking areas.

I agree not to leave valuables unattended.

13. No Guarantee of Safety

I understand that Pickle Haus Social cannot eliminate all risks. I understand that facility rules, staff presence, surveillance systems, access controls, lighting, maintenance, inspections, and safety procedures do not guarantee my safety and do not eliminate the risk of injury, illness, death, property damage, theft, or misconduct by others.

I voluntarily accept these risks.

14. Continuing Agreement

I understand and agree that this Agreement applies to my current visit and to all future visits, entries, reservations, memberships, passes, events, activities, spectating, and participation at or associated with Pickle Haus Social, unless I revoke it in writing.

Any revocation will apply only after Pickle Haus Social receives and processes the written revocation and will not affect any release, waiver, assumption of risk, indemnity, or obligation arising before the revocation.

Pickle Haus Social may require me to sign an updated waiver at any time.

15. Governing Law, Venue, Severability, and Entire Agreement

This Agreement shall be governed by the laws of the State of Texas.

To the fullest extent permitted by law, exclusive venue for any dispute arising out of or related to this Agreement, Pickle Haus Social, the facility, participation, spectating, entry, access, membership, reservations, or any related activity shall be in the state courts located in Gillespie County, Texas, or in a federal court with jurisdiction over that county.

If any portion of this Agreement is found invalid, unlawful, or unenforceable, the remaining portions shall remain in full force and effect to the fullest extent permitted by law.

This Agreement is the entire agreement regarding the matters addressed herein and may not be modified orally.

16. Electronic Signature and Digital Acceptance

I agree that this Agreement may be signed or accepted electronically, including by typed name, electronic signature, checkbox acceptance, online booking acceptance, membership portal acceptance, digital waiver system, or other electronic method.

I agree that my electronic signature or digital acceptance is intended to be legally binding and has the same effect as a handwritten signature.

Pickle Haus Social may maintain electronic records of this Agreement, including signature, date, timestamp, account information, reservation information, waiver version, and other associated records.

17. Final Acknowledgment

I HAVE CAREFULLY READ THIS AGREEMENT. I UNDERSTAND THAT IT IS A LIABILITY WAIVER, ASSUMPTION OF RISK, RELEASE, INDEMNITY, MEDICAL CONSENT, FACILITY ACCESS AGREEMENT, AND MEDIA RELEASE.

I UNDERSTAND THAT I AM GIVING UP IMPORTANT LEGAL RIGHTS.

I UNDERSTAND THAT THIS AGREEMENT RELEASES PICKLE HAUS SOCIAL AND THE OTHER RELEASED PARTIES FROM CLAIMS ARISING FROM THEIR OWN ORDINARY NEGLIGENCE, TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW.

I SIGN THIS AGREEMENT VOLUNTARILY.
